Kathryn is a leading competition and trade practices lawyer with over 17 years experience. She advises on the anti-competitive conduct and consumer protection provisions of the Trade Practices Act and associated state Fair Trading Acts.
Kathryn has advised and represented some of Australia's largest companies in competition law matters including Microsoft Corporation, CSR Limited, TNT Limited, British American Tobacco Australia Limited, Foster's Group, Johnson & Johnson Pacific Pty Limited, Woolworths Limited, Sony Australia Limited, Clorox Australia Pty Limited, Sumitomo Chemical Australia Pty Limited and Barloworld Australia Pty Limited.
She advises and represents clients on all aspects of the Trade Practices Act including:
- advising and representing clients in applications for approval of mergers including Johnson & Johnson (global acquisition of Pfizer's consumer healthcare), Barloworld (coatings industry), Greif Corporation (packaging industry)
- advising and representing clients in applications for leniency including applications for leniency across jurisdictions
- advising and representing clients in litigation involving allegations of breach of the anti-competitive conduct provisions of the Trade Practices Act (in particular cartel activity)
- applications for informal and formal merger clearances to the Australian Competition and Consumer Commission (ACCC)
- ACCC investigations and disputes
- litigation between competitors and with regulators involving allegations of anti-competitive conduct
- applications to the ACCC for authorisation of anti-competitive conduct
- negotiating and litigating infrastructure and services access arrangements
- reviewing and drafting agreements and documents to ensure compliance with competition laws
- product recalls.
Kathryn has particular expertise in acting on multi-jurisdictional transactions and in matters involving allegations of antitrust breaches across several jurisdictions. She is also an experienced commercial litigator and has conducted litigation in all Courts of New South Wales, the Federal Court of Australia, and before specialist tribunals including the Australian Competition Tribunal. She is a qualified mediator and an experienced advocate. Kathryn is also an Associate of the Australian Compliance Institute and an Associate Member of the American Bar Association (Antitrust).
