Nicole is a Partner in our Commercial Litigation & Dispute Resolution team. She has several years' experience in insolvency and commercial litigation. She has acted for many insolvency practitioners in Sydney in an advisory and litigious capacity, as well as creditors and directors.
Nicole regularly advises liquidators and administrators on all aspects of their appointments. Recent matters in which she has acted include:
- acting in the liquidation of a public company involving the distribution of assets via a creditors trust
- acting for a large educational institution in the winding up of organisations associated with it, and the transfer of their assets to a new company, involving several court applications and the provision of ongoing strategic, commercial and legal advice
- negotiating and drafting asset sale agreements on behalf of administrators and liquidators
- acting for insolvency practitioners in litigation seeking the recovery of assets, including physical assets and also property recoverable under the voidable transaction provisions of the Corporations Act
- acting for various lenders in the enforcement of securities and margin loans
- acting for directors or other insureds in claims against insurance companies under professional indemnity or directors and officers' insurance policies.
Nicole also has broad general commercial litigation experience, particularly in large-scale and complex matters in the Supreme and Federal Courts and the High Court. She has acted in disputes arising from the sale of businesses, auditor negligence proceedings, agency disputes, breach of contract claims, property/construction related disputes and administrative law proceedings. She also provides general commercial advice to insolvency practitioners and other clients and advises landlords on retail leasing issues.
Nicole is an active member of the Insolvency Practitioners Association of Australia (IPAA), having completed the IPAA course with distinction, and with several articles published in this field.
Nicole joined Addisons as a Senior Associate in October 2006. She has been a partner since July 2008.
