Hayden has been practising in commercial litigation for approximately 12 years and has broad experience advising and appearing for clients in commercial disputes and litigation. Hayden acts in alternative dispute resolution and litigation involving contractual disputes, commercial property and lease disputes, misleading conduct under the Trade Practices Act, business and shareholder disputes and appellate proceedings.
Hayden's recent experience includes:
- Mulpha Australia Limited - proceedings in the Federal Court of Australia against Principal Financial Services Inc for breaches of warranties in relation to Mulpha's $395 million purchase of Principal's hotel group in Australia, including the Hotel Intercontinental in Sydney and Hayman Island Resort in Queensland. The proceedings were settled during the course of the hearing.
- ACCC - proceedings in the Federal Court of Australia taken by the ACCC on behalf of over 30 individual investors against Global Prepaid Communications Pty Ltd and its directors in relation to contraventions of the consumer protection provisions of the Trade Practices Act and the Franchise Code of Conduct in a prepaid mobile telephone SIM card vending machine business.
- Pacific Carriers Limited - proceedings against BNP Paribas and others in relation to default under a bank guarantee for a shipment of cargo to India worth over $3 million. The proceedings started in the Supreme Court of NSW and eventually went on appeal to the High Court of Australia.
Hayden also has considerable experience in advising clients in the transport industry, particularly in the area of shipping litigation.
Hayden was admitted as a solicitor in 1998 and joined Addisons as a Senior Associate in November 2006. Before commencing at Addisons, Hayden was a Senior Associate with a high profile national firm.
